Welcome to Everwow
These Terms of Service (the “Terms”) form a binding agreement between you and MB Everwow (“Everwow,” “we,” “us,” or “our”). They govern your use of our website at everwow.com (the “Site”), our voucher products, and any services we provide (collectively, the “Service”).
Please read these Terms carefully. By using the Site, purchasing or redeeming a voucher, or otherwise engaging with the Service, you agree to be bound by these Terms.
1. Acceptance of These Terms
1.1 Agreement
By accessing or using the Service, you confirm that you have read, understood, and agreed to these Terms, our Privacy Policy, and our DMCA & Intellectual Property Policy (collectively, the “Agreements”). If you do not agree, do not use the Service.
1.2 Authority
You confirm that you have the legal capacity and authority to enter into these Terms. If you are accepting on behalf of an organization, you confirm that you are authorized to bind that organization to these Terms, in which case “you” refers to that organization.
1.3 Updates
Provisions for updating these Terms are described in the section titled Changes to These Terms.
2. What Everwow Is
2.1 Service Description
Everwow is an experience-gifting platform. We curate bundles of experiences and sell vouchers that the buyer can give as a gift. The recipient activates the voucher, browses the available experiences within the bundle at the time of redemption, selects one experience, and books it through our redemption flow.
2.2 What a Voucher Is
An Everwow voucher is a service certificate that entitles the recipient to redeem one experience from a designated bundle. Each voucher’s purchase includes (a) a redemption right of one selected experience and (b) Everwow’s curation, gift packaging, delivery, reveal experience, customer support, and platform services. Vouchers are not stored-value instruments, do not hold a cash balance, and have no monetary value outside the Everwow platform. Vouchers are fully consumed upon redemption.
2.3 Suppliers
The actual experiences delivered through Everwow are provided by independent third-party providers (the “Suppliers”). Suppliers operate under their own terms, conditions, safety practices, and policies, which apply once an experience is booked. Everwow facilitates the gift and the experience selection but does not directly provide the underlying experiences.
2.4 No Travel Sale
Everwow does not sell, arrange, or book travel. We sell prepaid service vouchers redeemable for curated experiences. Where an experience is booked, the booking is between the recipient and the Supplier. We are not a travel agent, tour operator, or seller of travel.
3. Eligibility
3.1 Age
You must be at least 18 years old to purchase a voucher or create an account. If you are between 13 and 17, you may use the Service only with the involvement and consent of a parent or legal guardian. The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13.
3.2 Compliance with Law
You confirm that your use of the Service complies with all applicable laws, that you are not on any sanctions or restricted-party list maintained by any government, and that you are not located in a country subject to comprehensive U.S. trade sanctions.
4. Accounts
4.1 Account Creation
You may purchase a voucher as a guest or by creating an account. Recipients must create an account to activate and redeem a voucher. Account creation requires accurate information, including your name, a valid email address, and acceptance of these Terms and our Privacy Policy.
4.2 Account Security
You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us promptly at support@everwow.com if you suspect any unauthorized use. We are not responsible for losses resulting from your failure to maintain account security.
4.3 Account Information Accuracy
You agree to keep your account information current and accurate. We may suspend or terminate accounts containing materially inaccurate information.
4.4 One Account Per Person
Each individual may maintain one account. Creating multiple accounts to evade restrictions, abuse promotional offers, or commit fraud is prohibited and may result in termination of all associated accounts and cancellation of vouchers obtained through such conduct, in accordance with Section 13.
5. What an Everwow Voucher Is
5.1 Prepaid Service Certificate
An Everwow voucher is a prepaid service certificate that entitles the Recipient to redeem one experience from a designated Bundle through the Everwow platform. Each voucher’s purchase price covers two things together:

The right to redeem one experience selected by the Recipient from the Bundle, and
-
Everwow’s services in connection with the gift, including curation of the Bundle, gift presentation and packaging, voucher delivery, the reveal experience, customer support, and our redemption and booking infrastructure.
The voucher’s purchase price is paid to Everwow in exchange for these combined services. It is not held in trust, segregated, or treated as deposit funds.
5.2 What a Voucher Is Not
To prevent any confusion, an Everwow voucher is none of the following:

Not a gift card or gift certificate with a stored monetary balance;

Not a stored-value instrument or prepaid card under federal Regulation E or the federal CARD Act;

Not a money transmission instrument or payment instrument;

Not a deposit, escrow, or trust fund;
-
Not redeemable for cash, exchangeable for cash equivalents, or refundable in part;
-
Not a security or investment;
-
Not a travel arrangement, tour package, or travel certificate.
5.3 Single Use
Each voucher entitles the Recipient to one experience redemption. Vouchers cannot be used for multiple experiences, partial redemption, or split bookings. Once a voucher is redeemed (used to book an experience), it is fully consumed and Everwow’s service obligations under that voucher are fulfilled.
5.4 Number of Participants
A voucher may be valid for one or more participants depending on the voucher type purchased. The applicable participant count is shown at the time of purchase and on the voucher itself. The Recipient may redeem the voucher for an experience that accommodates the specified number of participants.
6. Validity, Expiration, and Bundle Integrity
6.1 No Expiration
Your Everwow voucher does not expire. There is no deadline for the Recipient to redeem the voucher.
6.2 No Fees
We do not charge dormancy, inactivity, service, maintenance, or any other fees on vouchers. The voucher’s purchase price covers our services in full.
6.3 Bundle Composition
Each voucher is associated with a designated Bundle. The Bundle is curated by Everwow to offer a meaningful selection of experiences in the relevant category. The specific experiences within a Bundle may change over time as Suppliers and offerings evolve. We do not promise that any specific experience will be available indefinitely, and we do not display a fixed list of experiences as part of the voucher purchase. The Recipient sees the experiences then available within the Bundle when they enter the redemption flow.
6.4 Bundle Integrity Commitment
We commit to maintaining each Bundle’s curated quality and breadth for the foreseeable life of the voucher. If a Bundle’s experiences become substantially limited (for example, due to widespread Supplier withdrawal, discontinuation of a category, or other circumstances that meaningfully reduce the Bundle’s offerings), we may, at our discretion, offer the Recipient an alternative Bundle of comparable category, quality, and scope.
6.5 Supplier-Determined Experience Details
Suppliers, dates, locations, capacity, inclusions, age and health restrictions, and other experience details are determined by the relevant Supplier and may change over time. Specific experience pricing within a Bundle may change. The Recipient is entitled to redeem the voucher only against the experiences then available in the Bundle, on the terms then offered by the relevant Supplier.
7. The Voucher Lifecycle
Every Everwow voucher passes through five states:

8. Voucher Activation
8.1 What Activation Is
Your Everwow voucher is “activated” at the moment the Recipient receives the voucher and enters the Everwow reveal experience to claim it. Activation occurs whether the Recipient claims the voucher through the email reveal flow, the physical gift box reveal flow, or any other Everwow-provided activation channel.
8.2 What Activation Means
At the moment of Activation:

Everwow’s gift-giving service obligation is materially fulfilled.
-
The voucher belongs to the Recipient, who becomes the holder of the voucher.

The voucher remains valid for redemption indefinitely (no expiration).
-
The voucher is no longer refundable to the original Buyer, even within the 14-day refund window.
8.3 Disclosure to the Recipient
Before completing Activation, the Recipient is informed that continuing will activate the voucher and that, from that point, the voucher cannot be refunded by the Buyer. The Recipient may choose to delay Activation if needed.
8.4 Pre-Activation Cancellation
If the Buyer wishes to cancel a voucher before the Recipient has activated it, for example, if the gift was sent by mistake or to the wrong person, the Buyer should contact support@everwow.com immediately. We can cancel and refund a voucher that has not yet been activated.
9. Redemption
9.1 What Redemption Is
The voucher is “redeemed” when the Recipient selects a specific experience from the Bundle and confirms the booking with the Supplier through our redemption flow. Once a voucher is redeemed, it is fully consumed.
9.2 Available Experiences
At the time of Redemption, the Recipient will see the experiences then available within the voucher’s Bundle. The list of available experiences is curated and refreshed by Everwow over time. Suppliers, dates, locations, and inclusions are determined by Suppliers and may change. The Recipient is entitled to redeem the voucher only against the experiences then available.
9.3 Booking with the Supplier
Once an experience is selected, the booking is processed with the Supplier on the Recipient’s behalf. The booking creates a direct relationship between the Recipient and the Supplier for the delivery of the experience. The Recipient agrees to the Supplier’s terms and conditions, including the Supplier’s safety rules, age and health restrictions, cancellation policy, and any liability waivers, at the time of booking.
9.4 Confirmation
After booking, the Recipient receives a confirmation containing the booked experience details, the Supplier’s contact information, and any operational instructions.
9.5 No Substitutions for Booked Experiences
Once an experience is booked, the voucher is consumed against that booking. The Recipient cannot exchange the booked experience for a different experience after booking, except where the Supplier permits a change under its policies, or where Everwow agrees in its discretion to facilitate an exchange.
10. Supplier Policies and Experience Delivery
10.1 Independent Suppliers
The actual experience is delivered by an independent Supplier. The Supplier, not Everwow, is responsible for the operation, safety, quality, and conduct of the experience. The Supplier sets the terms, including age limits, health requirements, weather contingencies, equipment provided, what is and is not included, and the cancellation policy.
10.2 Supplier Cancellation and Refund Policies
Once an experience is booked, refund and cancellation rights are governed by the Supplier’s policy for that specific experience. Some experiences are non-refundable once booked and are clearly marked at the time of selection.
10.3 Non-Refundable Experiences
Certain experiences are designated by the Supplier as non-refundable once booked. These experiences are clearly marked in the redemption flow. Once a Recipient books a non-refundable experience, no refund is available and the related redemption right cannot be restored.
10.4 Supplier Failure or Cancellation
If a Supplier cancels, fails to deliver, or otherwise does not provide a booked experience as agreed, Everwow will work to facilitate either a comparable substitution or a refund through the Supplier where the Supplier permits. Our ability to obtain a refund or substitution depends on the Supplier’s cooperation. If a Supplier-side cancellation results in a refund of the experience cost, the redemption right associated with that experience is restored to the Recipient and remains valid for redemption against another eligible experience in the Bundle.
10.5 Recipient Failure to Attend
If the Recipient fails to attend a booked experience or cancels in violation of the Supplier’s cancellation policy, the voucher is consumed and no refund or restoration is available. The Recipient should follow the Supplier’s specific cancellation and rescheduling rules to preserve the value of the booking.
11. Lost, Stolen, or Compromised Vouchers
11.1 Unactivated Vouchers
If a voucher code is lost, misplaced, or shared inappropriately before Activation, contact support@everwow.com promptly. We may, at our discretion, issue a replacement code for an unactivated voucher. Replacement is not guaranteed and is subject to our verification and fraud-prevention review.
11.2 Activated Vouchers
Once a voucher has been activated, it has been claimed by the Recipient and is associated with their Everwow account. We do not generally issue replacements for activated vouchers, although we may assist with account recovery if a Recipient has lost access to their account due to circumstances beyond their control (such as a forgotten password or compromised email account).
11.3 Notification
Notify us as soon as you become aware that a voucher code has been compromised. Prompt notification helps us protect against unauthorized redemption.
11.4 No Liability for Misuse Through Buyer/Recipient Conduct
We are not responsible for losses resulting from a Buyer’s or Recipient’s failure to maintain reasonable security of voucher codes, for example, posting a voucher code publicly, sharing the code with someone other than the intended Recipient, or storing the code in an insecure manner.
12. Transfers, Resale, and Commercial Use
12.1 Transfer at Purchase
Vouchers are intended to be transferred at purchase from the Buyer to a designated Recipient. The Recipient may then redeem the voucher through their own redemption flow on the Everwow platform.
12.2 No Resale
Vouchers may not be resold, exchanged for value with a third party, traded, or used for commercial purposes. Vouchers obtained through unauthorized resale or trading are not eligible for support, replacement, or any other Everwow services. We may suspend or cancel vouchers we reasonably believe to have been obtained through unauthorized resale.
12.3 No Bulk Use Without Agreement
Bulk purchases for corporate gifting, employee appreciation, customer rewards, or similar programs require a separate agreement with Everwow. Contact corporate@everwow.com for corporate gifting arrangements.
12.4 Post-Activation Recipient Transfer
Once activated, a voucher is associated with the Recipient’s Everwow account and is generally not transferable. We may, in our discretion, accommodate a Recipient’s request to transfer an activated voucher to another individual in exceptional circumstances; any such accommodation is granted on a case-by-case basis through customer support.
13. Fraud Prevention and Anti-Abuse
13.1 Fraud Reservation
Everwow may suspend, cancel, or refuse to honor any voucher we reasonably believe to have been:

Purchased through fraud or unauthorized payment;
-
Obtained through identity theft or impersonation;
-
Acquired in violation of these Terms;
-
Used in connection with money laundering, sanctions evasion, or other illegal activity;
-
Subject to a chargeback, payment dispute, or unresolved payment issue; or
-
Acquired or used in a pattern that suggests abuse
This authority applies regardless of the voucher’s activation or redemption status.
13.2 Verification
To prevent fraud, we may require additional verification of the Buyer’s or Recipient’s identity, payment method, or contact details before processing a transaction or honoring a redemption. We may delay processing pending verification.
13.3 No Compensation for Suspended or Canceled Fraudulent Vouchers
If a voucher is suspended or canceled under this Section 13, neither the Buyer nor the Recipient is entitled to compensation, replacement, or refund of the redemption right. Where a chargeback or payment reversal occurs, the voucher is voided as of the date of the chargeback.
14. Voucher Status; Not Subject to Unclaimed Property Law
Vouchers are not bank accounts, deposits, or stored-value instruments. The voucher’s purchase price is paid to Everwow in exchange for our services. Voucher purchase prices are not held in trust, are not segregated funds. Everwow vouchers are designed as non-cash, single-use service entitlements and not as stored-value instruments or gift cards with a monetary balance..
15. Refund & Exchange Policy
15.1 Refund of Unactivated Vouchers (Within 14 Days)
You may request a refund of an Everwow voucher if both of the following are true at the time of your request:

The voucher has NOT been activated by the Recipient (see Section 8 for what activation means), AND
-
Your refund request is made within 14 days of the original purchase date.
If both conditions are true, we will refund the full order value to your original payment method. Email support@everwow.com with your order number, the email address used for purchase, and confirmation that the voucher has not yet been activated. We aim to confirm receipt within one business day and process eligible refunds within 5-10 business days. Refunds are made to the original payment method only.
15.2 No Refund After Activation
Once a voucher has been activated by the Recipient, the voucher cannot be refunded, even within the 14-day window, because Everwow’s gift-giving service has been delivered. The voucher belongs to the Recipient at that point. The voucher remains valid for redemption indefinitely.
15.3 When the Supplier Cancels or Fails to Deliver
If a Supplier cancels a booked experience, fails to provide it, or otherwise does not deliver as agreed, contact us at support@everwow.com promptly. We will work to facilitate either a comparable substitute experience or restoration of the redemption right so the Recipient can choose a different experience. Our ability to obtain a refund from a Supplier depends on the Supplier’s cooperation.
15.4 Sending Errors and Address Changes
If you sent a voucher to the wrong email address, contact us at support@everwow.com immediately. If the voucher has not yet been activated, we can cancel and re-issue it to the correct Recipient.
15.5 Lost or Compromised Vouchers
Lost or compromised vouchers are addressed in Section 11 (Lost, Stolen, or Compromised Vouchers). In summary: unactivated voucher codes may be replaced at our discretion subject to verification; activated vouchers generally cannot be replaced, but we can assist with account recovery when access is lost due to circumstances beyond the Recipient’s control.
15.6 Fraud, Disputes, and Suspended Vouchers
We may suspend or cancel any voucher we reasonably believe to have been purchased through fraud or in violation of these Terms (see Section 13). If you initiate a chargeback with your card issuer, the associated voucher may be suspended pending resolution. We strongly encourage you to contact support@everwow.com first.
If a voucher is canceled because we determine it was obtained through fraud, neither the Buyer nor the Recipient is entitled to compensation, replacement, or refund. Where a chargeback or payment reversal occurs, the voucher is voided as of the date of the reversal.
15.7 How We Process Refunds
Refunds are issued to the original payment method. We cannot refund to a different card, a different person, or in another form (such as cash, check, or store credit). If you used a Buy Now Pay Later provider, refunds are processed back to that provider, who will adjust your installment schedule.
15.8 Your State-Specific Rights
Some U.S. states provide consumers with additional protections beyond what is described in this Section. Where state law provides greater consumer rights than this Section, those state-law rights apply in addition to (or instead of, where required by law) the rules in this Section. Nothing in this Section is intended to limit any rights you have under applicable state law that cannot be waived by contract.
16. Shipping & Delivery
16.1 Digital Voucher Delivery
Digital vouchers are delivered by email to the Recipient’s address you specify at checkout. Delivery is instant, typically within minutes of purchase confirmation. The Recipient receives an email with the voucher code, a personal message from you (if you included one), and instructions to claim and redeem the voucher.
If you prefer to send the voucher on a specific future date, for a birthday, anniversary, or other occasion, you can schedule delivery at checkout. We will hold the voucher and deliver it on the date you select. You can change or cancel a scheduled delivery up until the scheduled send date by contacting support@everwow.com.
It is the Buyer’s responsibility to provide a correct and current Recipient email address. If the address is incorrect:

If the voucher has not yet been activated, contact support@everwow.com — we can correct the address and resend the voucher;
-
If the voucher has been activated, we may not be able to redirect it; contact us and we will work with you on options.
Sometimes voucher emails are routed to spam or promotions folders by email providers.
If a Recipient does not see the voucher email, they should check spam, junk, or promotions folders, add gifts@everwow.com to their address book, or search for “Everwow” or the Buyer’s name in their email. If the email cannot be located after these steps, contact support@everwow.com — we can resend it.
Buyers who want to deliver a voucher in person — for example, to print and place in a card — can choose the self-print delivery option at checkout. The voucher is delivered to the Buyer’s email instead of the Recipient’s, with a print-friendly format the Buyer can hand to the Recipient.
16.2 Physical Gift Box Delivery
Physical gift boxes are an optional add-on. Physical gift boxes typically ship within 1–2 business days of order placement, with standard delivery within the contiguous United States in 3–5 business days. Alaska, Hawaii, other U.S. territories and Rest of the World may take longer. Expedited shipping options are available at checkout where indicated. Shipping fees are non-refundable once the package has shipped.
16.3 Undeliverable, Lost, or Damaged Packages
If a physical gift box is returned as undeliverable, lost in transit, or arrives damaged, contact us at support@everwow.com with your order number and photos where applicable. We will arrange a replacement or refund consistent with Section 15.
16.4 Where We Ship
We ship physical gift boxes worldwide. Digital vouchers are delivered by email and can be sent to recipients anywhere in the world.Recipients can redeem their voucher for eligible experiences in the country or location where the selected experience is offered, subject to availability and any location-specific terms..
16.5 Peak Season
Physical gift box shipping windows may be longer than standard during major holidays. Digital vouchers continue to deliver instantly year-round. We publish recommended holiday ordering deadlines on our website.
17. Pricing, Payment, and Taxes
17.1 Prices
All prices are listed in exclude applicable taxes. Prices, available bundles, and available experiences may change without prior notice. The price applicable to a voucher purchase is the price displayed at the time of checkout.
17.2 Payment
We accept payment through methods displayed at checkout, which may include major credit and debit cards, digital wallets, and Buy Now Pay Later providers (such as Klarna). By providing payment information, you confirm that you are authorized to use the payment method and that the information is accurate.
17.3 Buy Now Pay Later
If you select a Buy Now Pay Later option at checkout, your transaction will be processed by the BNPL provider and you will be subject to that provider’s separate terms and conditions. Everwow is not the BNPL lender.
17.4 Taxes
Your purchase may be subject to sales tax or similar taxes depending on your jurisdiction. Where Everwow is required to collect taxes, the applicable amount will be calculated and added at checkout.
17.5 Pricing Errors
If a price is displayed in error, we reserve the right to cancel the affected order and refund any payment. We will notify you of the error and offer to rebook at the corrected price.
18. Intellectual Property
18.1 Our Content
The Site, the Service, and all content provided by Everwow, including text, graphics, photos, illustrations, video, software, design, and trademarks, are owned by us or our licensors and are protected by intellectual property laws. “Everwow” and our logos are our trademarks. You may not use them without our prior written consent.
18.2 Limited License to Use the Service
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site and Service for personal, non-commercial use in accordance with these Terms.
18.3 Third-Party Content
Some content on the Site is provided by third parties, including Suppliers. We do not own or control that content and are not responsible for its accuracy. Third-party content remains the property of its respective owner.
18.4 Copyright Complaints (DMCA)
We respect intellectual property rights. If you believe content on the Site infringes your copyright, please contact our designated DMCA agent at dmca@everwow.com. Our full procedures for handling copyright and other intellectual property complaints are set out in our DMCA & Intellectual Property Policy.
19. User Content and Conduct
19.1 Your Content
You may submit content to the Service, including video greetings, written messages, photos, and reviews (“User Content”). You retain ownership of your User Content. The licensing terms governing User Content are set out in Section 20.
19.2 Prohibited Conduct
You agree not to use the Service in any way that violates any law, infringes any intellectual property right, misrepresents your identity, interferes with or disrupts the Service, attempts unauthorized access, or uses the Service for any commercial purpose without our consent.
19.3 Moderation
We may, but are not obligated to, review activity on the Service. We may suspend or terminate accounts that violate these Terms. Moderation of User Content is described in Section 20.6.
20. Video Greetings and User-Generated Content
20.1 Scope
This Section applies to video greetings, personal text messages, reviews, photos, audio recordings, and other content you upload or transmit through the Service.
20.2 Video Greeting Consent and Process
During the gift creation flow, we offer the option to record a video greeting captured through your device’s camera. Before you start recording, we display a notice that recording is optional; if you proceed, your video will be stored and delivered to the gift Recipient; your video will be retained according to Section 20.7; and we perform automated content review but do NOT perform face detection, face recognition, or any biometric processing.
If your video greeting includes other people, you confirm you have those individuals’ permission to record and share the video. If a minor under 13 appears, you must be the parent or legal guardian or have express parental consent.
20.3 Ownership and License
You retain all ownership rights in your User Content. By submitting User Content, you grant Everwow a worldwide, non-exclusive, royalty-free license to host, store, transmit, display, and use the content to operate the Service and deliver it to your designated Recipient. This license terminates when the content is deleted, subject to reasonable backup retention.
20.4 No Marketing Use
We will NOT use your video greetings, personal messages, or other personally identifiable User Content for marketing or advertising without your separate explicit consent.
20.5 Prohibited Content
You agree not to submit User Content that violates any law; infringes any intellectual property right; is sexually explicit or pornographic; depicts violence, abuse, or graphic harm; depicts illegal activity; sexualizes or endangers minors; is harassing, threatening, defamatory, or constitutes hate speech; promotes self-harm; or misrepresents your identity.
20.6 Content Moderation
We perform automated content review on submitted User Content to detect prohibited content including violence, nudity, illegal activity, exploitation of minors, hate speech, and harassment. WE DO NOT PERFORM FACE DETECTION, FACE RECOGNITION, BIOMETRIC MATCHING, OR ANY OTHER BIOMETRIC PROCESSING ON YOUR USER CONTENT.
Content that passes review is delivered to the Recipient. Content flagged for prohibited material may be withheld. In serious cases, content may be reported to law enforcement. If your content is withheld and you believe this was in error, contact support@everwow.com.
20.7 Retention and Deletion
Video greetings are retained until the earlier of: (a) twenty-four months from the date of recording, or (b) thirty days after the Recipient redeems the associated voucher. After the applicable period, video greetings are permanently deleted. You may request deletion of your User Content at any time by emailing privacy@everwow.com.
20.8 Reporting concerning content
Recipients can report concerning content by clicking the “Report” button in the reveal experience or contacting support@everwow.com. We will review reports and take appropriate action, including removal, user notification, and escalation to law enforcement where applicable.
20.9 IP complaints
IP complaints about User Content should be sent to dmca@everwow.com per our DMCA & Intellectual Property Policy.
20.10 No general monitoring obligation
We do not have a general obligation to monitor every piece of User Content. Our liability for User Content is limited as described in Sections 23 and 24.
21. Reviews and Testimonials
21.1 Your Reviews
If you submit a review, you confirm that it is your honest opinion based on your actual experience and that you do not have any undisclosed material connection to Everwow. You may edit or delete your own review at any time.
21.2 Third-Party Review Platforms
We use independent third-party review platforms (such as Trustpilot and Loox) to collect and display reviews. Reviews collected by these platforms are subject to the platforms’ own terms and may be visible on third-party websites that we do not control.
22. Third-Party Services and Suppliers
22.1 Suppliers
Each experience available through the Service is provided by an independent Supplier. Suppliers are responsible for the actual delivery, quality, safety, and conduct of the experience. By booking an experience, you agree to the Supplier’s terms, conditions, safety rules, age and health restrictions, and cancellation policy.
22.2 Some Experiences Are Non-Refundable Once Booked
Some experiences are designated by the Supplier as “all sales final” or non-refundable once booked. These experiences are clearly marked at the time of selection. Once a Recipient books such an experience, no refund of the experience itself is available, and the related redemption right cannot be restored.
22.3 Supplier Cancellations and Issues
If a Supplier cancels, fails to deliver, or otherwise does not provide a booked experience as agreed, we will work to facilitate a comparable substitution or a refund through the Supplier where the Supplier permits. Our ability to obtain a refund or substitution depends on the Supplier’s cooperation. We are not the operator of the experience and cannot guarantee Supplier conduct.
22.4 Third-Party Sites and Tools
The Site may link to or integrate with third-party websites, applications, and tools (such as payment processors, BNPL providers, analytics tools, customer support tools, and review platforms). We are not responsible for those third parties’ practices. Your use of a third-party service is governed by that party’s terms and policies.
23. Disclaimers
The service and any content, products, or experiences accessible through the service are provided on an “as is” and “as available” basis, without warranties of any kind, to the maximum extent permitted by applicable law.
Everwow does not warrant the conduct, services, or experiences of suppliers. The quality, safety, legality, and delivery of any experience is the responsibility of the relevant supplier.
Some jurisdictions do not allow the exclusion of certain warranties. To the extent that such exclusions are not permitted, the warranties disclaimed in this Section are limited to the maximum extent permitted by applicable law.
24. Limitation of Liability
To the maximum extent permitted by applicable law, Everwow and its officers, directors, employees, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to your use of the service, these terms, any experience, or any supplier conduct.
Everwow’s total cumulative liability to you for all claims will not exceed the greater of (a) the total amount you paid to Everwow for the voucher giving rise to the claim, or (b) one hundred U.S. dollars ($100).
Nothing in these terms excludes or limits Everwow’s liability for fraud, fraudulent misrepresentation, or death or personal injury caused by Everwow’s gross negligence.
25. Indemnification
You agree to defend, indemnify, and hold harmless Everwow and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use or misuse of the Service; (b) your User Content; (c) your violation of these Terms; (d) your violation of any law or third-party right; (e) claims that your User Content infringes third-party rights; or (f) claims arising from third parties depicted in your User Content.
26. Privacy and Data Use
Your use of the Service is governed by our Privacy Policy, which is incorporated by reference into these Terms. The Privacy Policy describes what personal information we collect, how we use it, your rights under applicable U.S. state privacy laws, and our handling of cookies and tracking technologies.
27. Termination
27.1 Your Right to Stop Using the Service
You may stop using the Service at any time. You may close your account by contacting support@everwow.com. Closing your account does not entitle you to a refund of any voucher beyond what is permitted under Section 15.
27.2 Our Right to Suspend or Terminate
We may suspend or terminate your access to the Service if we reasonably believe you have violated these Terms or applicable law, or if we are required to do so by law. Where the suspension is not for cause, we will refund any unused, unactivated voucher in accordance with Section 15.
27.3 Survival
Sections 18, 23, 24, 25, 29, and 33 will continue to apply after termination.
28. Modifications to the Service
We may modify, suspend, or discontinue the Service or any feature of the Service at any time, with or without notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuation, except that vouchers already purchased remain governed by the Terms in effect at the time of purchase, including the bundle integrity commitment in Section 6.4.
29. Governing Law and Dispute Resolution
29.1 Governing Law
These Terms are governed by the laws of the Republic of Lithuania, without regard to its conflict of law principles.
29.2 Class Action Waiver
To the maximum extent permitted by applicable law, all disputes shall be brought in the parties’ individual capacity only. The arbitrator shall not consolidate the claims of more than one person.
29.3 Mass Arbitration Procedure
If 25 or more substantially similar arbitration demands are filed within 90 days, 10 representative cases shall proceed first as bellwether cases. Remaining cases are stayed pending their outcome. Following the bellwether arbitrations, the parties shall mediate remaining claims using the bellwether outcomes as a framework.
29.4 Small claims
Either party may bring an individual action in small claims court for disputes within that court’s jurisdiction.

31. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or by a notice on the Site at least 30 days before the changes take effect. Continued use of the Service after updated Terms take effect constitutes acceptance of those updates. Vouchers purchased before an update remain governed by the Terms in effect at the time of purchase.
32. Miscellaneous
32.1 Entire Agreement
These Terms, together with the Privacy Policy and the DMCA & Intellectual Property Policy, constitute the entire agreement between you and Everwow regarding the Service. They supersede any prior or contemporaneous agreements or understandings.
32.2 No Waiver
Our failure to enforce any provision of these Terms is not a waiver of that provision or of any other provision.
32.3 Severability
If any provision of these Terms is held unenforceable, the remaining provisions will continue in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
32.4 Assignment
You may not assign or transfer these Terms or your rights or obligations under them, in whole or in part, without our prior written consent. We may assign these Terms freely, including to an affiliate or in connection with a merger, acquisition, or sale of assets. Any attempted assignment in violation of this section is void.
32.5 Force Majeure
We will not be liable for any delay or failure to perform our obligations under these Terms due to causes beyond our reasonable control, including acts of God, natural disasters, pandemics, war, terrorism, civil unrest, government action, labor disputes, supplier failures, internet or telecommunications outages, or other similar events.
32.6 Headings
Section headings are for convenience only and do not affect interpretation.
32.7 Independent Contractors
Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and Everwow.

The following defined terms have the meanings given below.
